1. Introduction
These terms and conditions govern your use of the no-cloud.uk website and the purchase of products sold through it. Please read them carefully before placing an order.
In these terms, "we", "us", and "our" refer to NoCloud, a sole trader based in the United Kingdom. "You" and "your" refer to the customer.
By placing an order through our website, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree with any part of these terms, you should not use our website or place an order.
2. Products
We sell physical hardware products designed for aquarium automation under the AquaHub brand. Our product range includes display units, pump assemblies, water level sensors, water quality sensors, and smart dosing units.
We make every effort to ensure that product descriptions, specifications, and images on our website are accurate and up to date. However, minor variations may occur between the product shown on the website and the product delivered. Such variations do not constitute a defect.
All NoCloud products run custom firmware with no cloud dependency. Your devices operate entirely on your local network and do not require an internet connection for core functionality.
3. Pre-Orders
Certain products may be made available for pre-order before they are in stock and ready to ship. When you place a pre-order, full payment is taken at the time of ordering.
Estimated delivery dates for pre-orders are provided in good faith but are not guaranteed. We will keep you informed of any significant changes to expected delivery timescales.
If we are unable to fulfil a pre-order for any reason, we will notify you promptly and issue a full refund to your original payment method within 14 days.
4. Pricing and Payment
All prices displayed on our website are in British Pounds Sterling (GBP) and include VAT where applicable.
Payment is processed securely via Stripe. We do not see, store, or have access to your card details at any point during or after the transaction. All payment data is handled directly by Stripe in accordance with PCI DSS standards.
We reserve the right to correct any pricing errors discovered before an order has been dispatched. If a pricing error affects your order, we will contact you to confirm whether you wish to proceed at the correct price or receive a full refund.
5. Shipping and Delivery
We currently ship to addresses within the United Kingdom only. We intend to expand our delivery regions in the future and will update our website accordingly.
Delivery timeframes provided at checkout and in order confirmations are estimates and are not guaranteed. We are not liable for delays caused by postal services, courier companies, or circumstances outside our reasonable control.
Risk in the products passes to you upon delivery. If a delivery is lost or damaged in transit, please contact us as soon as possible so we can investigate and resolve the issue.
6. Warranty
All NoCloud products are covered by a 12-month warranty from the date of delivery. This warranty is in addition to, and does not affect, your statutory rights under the Consumer Rights Act 2015.
The warranty covers:
- Defective components
- Manufacturing faults
- Firmware issues that prevent normal operation
The warranty does not cover:
- Water damage resulting from improper installation
- Physical damage caused by misuse, accident, or negligence
- Normal wear and tear
- Damage resulting from unauthorised modification of the hardware or firmware
To make a warranty claim, please contact us via WhatsApp. We will assess the claim and, if valid, offer a repair, replacement, or refund at our discretion.
7. Firmware
All NoCloud devices run custom firmware that operates locally without cloud connectivity. Firmware updates are provided free of charge and can be installed via WiFi when available.
While we do not guarantee perpetual firmware updates, we are committed to supporting our products for as long as reasonably practicable. Critical security and bug-fix updates will be prioritised.
You are free to modify the firmware on your devices at your own risk. However, any modification to the firmware constitutes unauthorised alteration and will void the product warranty. This does not affect your statutory rights regarding the physical hardware itself.
8. Limitation of Liability
To the maximum extent permitted by applicable law, NoCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of livestock, damage to aquarium equipment, or business interruption, arising out of or in connection with the use of our products.
Our total aggregate liability in respect of any claim arising out of or in connection with these terms or the use of our products shall not exceed the purchase price you paid for the relevant product.
Nothing in these terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any matter for which it would be unlawful to exclude or limit liability
These terms do not affect your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable legislation.
9. Cancellation
If you have placed a pre-order, you may cancel it at any time before the product has been dispatched. A full refund will be issued to your original payment method within 14 days of the cancellation.
For products that have already been delivered, your right to return is governed by our Returns & Refunds policy. You also have the right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 within 14 days of receiving the goods.
10. Intellectual Property
All firmware, software, branding, trademarks, website content, and design are the intellectual property of NoCloud and are protected by applicable intellectual property laws.
The physical hardware you purchase is your property. You may use it as intended and modify it for personal use.
You may not reverse-engineer, decompile, or disassemble our firmware for commercial purposes. You may not reproduce, distribute, or create derivative works from our website content, branding, or software without our prior written consent.
11. Governing Law
These terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have non-exclusive jurisdiction over any dispute arising out of or in connection with these terms. If you are a consumer, you may also bring proceedings in the courts of the country in which you are domiciled.
12. Changes to These Terms
We may update these terms from time to time to reflect changes in our practices, products, or legal requirements. Any changes will take effect immediately upon being posted on this page.
We encourage you to review these terms periodically. Your continued use of our website or purchase of products after changes have been posted constitutes your acceptance of the revised terms.
